Welcome to BAPE Sweater, a destination for authentic A Bathing Ape sweaters, hoodies, and streetwear. By accessing or using bapesweater.com (the “Site”) and our services, you agree to be bound by these Terms & Conditions (the “Terms”). If you do not agree, please do not use the Site.

In these Terms, “BAPE Sweater,” “we,” “us,” or “our” refers to the entity operating bapesweater.com. “You” or “your” means the user or customer of the Site.

1. Acceptance of Terms

By using the Site, creating an account, or placing an order, you confirm that you have read, understood, and agree to these Terms as well as any policies referenced herein, including our Privacy Policy and Refund & Returns Policy.

2. Eligibility & Account

• You must be at least 18 years old (or the age of majority in your jurisdiction) to purchase from the Site.
• You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
• We reserve the right to suspend or terminate accounts for suspected fraud, violation of these Terms, or harmful conduct.

3. Orders & Contract Formation

• Your order is an offer to purchase. Acceptance occurs when we send an order confirmation email and charge your payment method.
• We may refuse or cancel any order at our sole discretion, including due to product availability, pricing or listing errors, suspected fraud, or violation of these Terms. If payment was captured, you will receive a prompt refund for any cancelled portion.
• Please review your shipping address and order details carefully; we are not responsible for errors entered by the customer.

4. Pricing, Taxes & Payment

• Prices are listed in USD unless stated otherwise and are subject to change without notice.
• Applicable taxes, duties, and shipping costs are calculated at checkout based on your address and selected service.
• We accept major payment methods as displayed at checkout (e.g., Visa, Mastercard, PayPal). By submitting payment, you represent that you are authorized to use the chosen method and authorize us to charge the full order amount, including taxes and shipping.
• In the event of a pricing error, we may cancel the order or request your confirmation of the corrected price before processing.

5. Shipping, Delivery & Risk of Loss

• We ship from the United States using trusted carriers. Estimated delivery windows are provided at checkout and start when your order ships.
• Risk of loss transfers to you upon delivery to the shipping address or carrier based on the terms of the selected shipping service.
• Please track your package using the tracking link provided. If a package is marked delivered but cannot be located, contact the carrier first, then our support team.
• International shipments may be subject to customs clearance delays beyond our control.

6. Returns & Refunds

• Our full policy is available at Refund & Returns Policy. In general, items must be returned in the same condition as received, with all original tags and packaging where applicable.
• Unauthorized returns may be refused. Refunds (if approved) are issued to the original payment method, less shipping fees unless the return is due to our error.
• For size/fit concerns, please consult measurements on the product page before purchasing.

7. Authenticity, Condition & Sizing

• Authenticity: Every BAPE item we sell is hand-authenticated and covered by our lifetime authenticity promise. If an item is ever proven inauthentic, we will provide a full refund upon return.
• Condition: Listings include detailed photos and condition notes. As many BAPE pieces are limited or past-season releases, minor variations or signs of age may be present and are disclosed when known.
• Sizing: BAPE silhouettes can run boxy and slightly short. Refer to exact measurements on each product page and consider sizing up for length if preferred.

8. Product Information & Availability

• We strive for accuracy in titles, descriptions, photos, pricing, and availability. However, errors may occur and we reserve the right to correct them.
• Color display can vary by device; slight differences from on-screen appearance are not considered defects.
• Inventory is limited and may sell out quickly due to high demand for BAPE drops and archive pieces.

9. Promotions, Gift Cards & Credits

• Promotional codes are valid only for the period and on the items specified and cannot be combined unless stated.
• Gift cards and store credits are non-refundable, not redeemable for cash (unless required by law), and may be subject to additional terms provided at issuance.

10. Acceptable Use & Prohibited Conduct

• Do not misuse the Site, including attempting to interfere with security features, scraping, automated data collection without consent, or engaging in fraudulent activity.
• Do not post or transmit content that is unlawful, infringing, defamatory, or harmful.
• We may suspend access for violations or for activity that risks harm to the Site, our customers, or our brand partners.

11. Reviews & User Content

• By submitting reviews, photos, or other content, you grant BAPE Sweater a worldwide, non-exclusive, royalty-free license to use, reproduce, display, and distribute such content in connection with the Site and our marketing, in any media now known or later developed.
• You represent that you own or have permission to use any content you submit and that your content complies with these Terms and applicable laws.

12. Intellectual Property

• All Site content (including text, graphics, logos, images, and code) is owned by or licensed to BAPE Sweater and is protected by applicable intellectual property laws. You may not use, copy, or distribute Site content without our prior written consent.
• "BAPE" and "A Bathing Ape" are trademarks of their respective owners. BAPE Sweater is an independent retailer/reseller and is not affiliated with, endorsed by, or sponsored by A Bathing Ape unless expressly stated.

13. Third‑Party Links & Services

The Site may contain links to third‑party websites or services. We do not control or endorse third‑party content and are not responsible for their policies or practices. Access third‑party sites at your own risk.

14. Disclaimer of Warranties

Except for our explicit authenticity promise, the Site and all products and services are provided on an “as is” and “as available” basis without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non‑infringement. Applicable law may not allow the exclusion of certain warranties; to that extent, such exclusions may not apply to you.

15. Limitation of Liability

To the maximum extent permitted by law, in no event shall BAPE Sweater, its owners, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of or inability to use the Site or products purchased. 18. Dispute Resolution & Arbitration

• Any dispute, claim, or controversy arising out of or relating to these Terms or the Site that cannot be resolved informally shall be determined by binding arbitration administered by a recognized arbitration provider in New York County, New York. You and BAPE Sweater waive the right to a jury trial.
• Class Action Waiver: You and BAPE Sweater agree that any proceedings shall be conducted only on an individual basis and not in a class, consolidated, or representative action.
• Nothing prevents either party from seeking injunctive or equitable relief in a court of competent jurisdiction to protect intellectual property or proprietary rights.

19. International Orders

• International customers are responsible for any import duties, customs, and local taxes. These fees are not included in the product price or shipping cost unless stated.
• Ensure that the items you purchase comply with your local laws and import restrictions.
